A Terrell man was arrested on Tuesday after police say he drove off the road at a high speed before crashing into a tree.
The driver, Jessie Steve Garcia II, was arrested and is being charged with two counts of driving while intoxicated with a child under 15 years of age, two counts of intoxication assault with a vehicle and two counts of endangering a child with an imminent bodily injury after his vehicle struck a tree in the 200 block of Town North Drive just after 5 p.m.
Garcia's two children – a 1-year-old and a 3-year old – were in the car during the accident, and, according to a police report, both children "received serious injuries to the head and face."
Garcia's car only had one child safety seat, according to the police report.
The children were transported together to Children's Hospital in Dallas by CareFlight air. Both children remain in the hospital.
Garcia was transported to Presbyterian Hospital of Kaufman and treated for his injuries. He was released and remains in the custody of the Terrell Police Department. He is expected to be transferred to the Kaufman County Law Enforcement Center sometime today.
Police say the crash is still under investigation, but at this time they believe the primary cause is driver intoxication.
